MINUTES OF THE PUBLIC MEETING OF JULY 13TH, 2004
HANSON TOWN HALL, LIBERTY ST., HANSON, MA

Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman, in the Conservation Office on the second floor of Town Hall.

Public Hearings

8:00 PM  Notice of Intent for construction of a single family house and associated site work within the 100-foot buffer zone at 108 Pleasant St. (Rear) Map 32, Lot 37-1 with Richard & Melly Eaton represented by Goscon, Inc., P. O. Box 182, Kingston, MA  02364.  (DEP #175-)  (New Hearing)

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Darren Grady of Grady Consulting presented a plan for a single-family house and a paved driveway on a retreat lot.  All work is outside the 50-foot no-disturb zone.  The septic is outside the 100-foot buffer zone.  Brooke Munro did the delineation.  Phil Lindquist called off the abutter’s list.  A Mr. John Cannon looked at the map, but had no questions.

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Leanne Bradley of Outback Engineering presented the proposal.  It is a pre-existing house that was destroyed by fire, and therefore exempt from the River’s Act.  The septic plan is currently being revised but will be out of the 100-foot buffer zone.  The area is already landscaped and no trees are to be cut down.  The footprint or foundation of the house will remain the same.  Phil Lindquist read off the abutter’s list.  None were present.  Mr. Grattan had concerns about the storage of materials within the flood-plain zone.

8:30 PM Continued Abbreviated Notice of Resource Area Delineation to determine the accuracy of the wetland line at 162 Industrial Blvd., Assessor’s Map 59, Lots 17-7 & 17-8 for J & G Mgmt. LLC represented by Coneco Engineers & Scientists, 4 First St., Bridgewater, MA  02324  (DEP #175-427)

Richard Kirby of LEC attended.  Ms. Delaney had inspected the wetland line with him and agreed with the delineation with the exception of one flag (I-8) which they moved about 20-feet. Her recommendation is that a new plan showing the relocation of the flag be submitted.

8:45 PM  Continued Notice of Intent for construction of a single family house, subsurface sewage disposal system, access driveway, utilities and grading at Lot 5, Ransom Road, Assessor's Map 63, Lot 1 for applicant Michael Casey, 24 Meadow Ln., Hanson represented by Land Planning, Inc., 1115 Main St., Hanson, MA.  (DEP #175-432)   

Bernard Munro of Land Planning, Inc. and Mr. & Mrs. Casey attended the hearing.  Mr. Munro presented a new plan showing the existing haybale line and the relocation of the retaining wall.  He submitted a Request for Variance (see attached) as the retaining wall now falls within the 50-foot no disturb zone.   The Commission has inspected the property.  Ben Gilmore is working on the replication plan.  Mr. Munro suggested that the Enforcement Order be lifted so the retaining wall and well can be staked out.

9:00 PM  Continued Notice of Intent for construction of access drive, utilities, buildings and related grading partially within the 100-foot buffer zone at 255 rear Liberty St., Assessor's Map 82, Plot 6-1 for Dennis Leary, 2 Columbia Rd., Pembroke, MA represented by Keefe Assoc., Hudson Park Realty Assoc. RT, 2 Columbia Rd., Pembroke, MA  02359  (DEP #175-433)

Dennis Leary and representatives, John Keefe and John Burnes of Keefe Associates attended the hearing.  The Commission had made a site walk and Phil Lindquist noted that there were problems with the flagging.  Interim Agent, Janine Delaney inspected on July 7th and observed that several flags were missing.  She did not go beyond the site to check the wetland line as she would like to obtain permission from the owners first.    Ms. Delaney observed wetland vegetation on the south side of the driveway as well as possible wetland filling.  She would like to set up an appointment with the botanist, Brook Munro to go over the line.  Also, she suggested that a new plan that shows the driveway be submitted as this is a potential enforcement issue.

Mr. Young attended and presented a new plan showing the correct flagging.

Mr. Kirby presented a plot plan of an un-developed retreat lot.  He wanted to run by the Board whether there would be a possibility that the lot could be developed.  The eventual proposal would call for mitigation of wetlands for the construction of the driveway.   Ron Grattan mentioned the 50-foot no disturb zone.   Mr. Kirby wanted to know if because the lot was created before 1998 when the regulation was enacted, it would be grand-fathered in.    The Board told him that it would depend on when the lot was created.  Mr. Kirby will do some research.

9:30 PM Appointment with Will Wessel to discuss a Building Permit Application for 1034 Franklin Street, owner’s Pierre & Gail Monfils.

Mr. Wessel had questions about filing procedures.  The Board advised him to hire a botanist and file the necessary paperwork if it is warranted.
